F-1 to H-1B: How Cap-Gap Bridges OPT to Your Start Date

Cap-gap bridges the gap between your OPT ending and H-1B employment starting. A 2025 DHS rule extended it from 1 October to 1 April — and most guidance online still describes the old window.

If you are on F-1 OPT and an employer files an H-1B for you, there is a gap: your OPT ends on one date and H-1B employment starts on another. Cap-gap is the mechanism that bridges it — and in January 2025 DHS extended how far it reaches.

What cap-gap actually is

In the words of USCIS, the cap-gap period "starts when an F-1 student's status and employment authorization expires and, unless terminated, ends on April 1 of the fiscal year for which the H-1B status is being requested or until the validity start date of the approved petition, whichever is earlier."

Two dates define it. It begins when your F-1 status and work authorisation would otherwise run out, and it ends at whichever comes first: 1 April of the relevant fiscal year, or the day your approved H-1B actually starts.

This is longer than it used to be. A DHS final rule effective 17 January 2025 extended cap-gap from 1 October to 1 April of the relevant fiscal year, applied to eligible F-1 students who are beneficiaries of a timely filed cap-subject petition beginning with the FY 2026 registration period. Guidance written before 2025 describes the shorter window and is now wrong.

The conditions, precisely

Cap-gap is not automatic because you have an H-1B pending. USCIS requires that the cap-subject petition be properly and timely filed during the H-1B filing period beginning 1 April, while your authorised F-1 duration of status (D/S) admission was still in effect, and that it request a change of status to H-1B within the fiscal year for which status is sought.

ConditionWhy it fails in practice
Petition properly and timely filedAn employer that files late, or whose filing is rejected, takes the bridge away with it
Your F-1 D/S admission still in effect at filingIf your status has already lapsed, there is nothing for cap-gap to extend
Requests change of status, not consular processingA petition filed for consular processing does not trigger cap-gap
You are in a valid period of F-1 statusFor the employment extension specifically, you must be on post-completion OPT or STEM OPT

That third row is the one worth raising with your employer's immigration counsel early. Change of status and consular processing are both legitimate routes to an H-1B, but only one of them keeps you working in the meantime.

If the petition fails

If the H-1B petition is denied, rejected, revoked or withdrawn, the cap-gap extension terminates. USCIS states the student then has the standard 60-day grace period, measured from the date of notification of that denial, rejection, revocation or withdrawal, to depart the United States.

The 60 days run from notification, not from your original OPT end date. That distinction decides how much time you actually have, and it is the thing to establish immediately if a petition goes wrong — not something to work out later.

The sequence, in order

  1. You are on post-completion OPT or STEM OPT, in valid F-1 status.
  2. From 1 April, your employer files a cap-subject H-1B petition requesting a change of status, while your D/S admission is still in effect.
  3. Cap-gap extends your F-1 status and, if you are on post-completion or STEM OPT, your employment authorisation.
  4. The extension runs until 1 April of the relevant fiscal year, or until your approved H-1B validity start date — whichever is earlier.
  5. If the petition is denied, rejected, revoked or withdrawn at any point, the extension ends and the 60-day grace period begins from the notification date.

What to confirm with your DSO

Cap-gap touches your SEVIS record, which your Designated School Official maintains. Ask them to confirm that your record reflects the cap-gap extension once the petition is filed, and keep your own copy of the filing receipt.

Your DSO is the right first call for anything about your record. An immigration attorney — usually your employer's — is the right call for anything about the petition itself. Neither question should be settled from a forum post.

What is not in this guide

We have not published H-1B cap figures, registration mechanics or selection rules here — those sit in our separate H-1B guide, sourced from the USCIS cap pages. We have also not published the specific unemployment-day limits that apply during OPT, because the USCIS OPT page does not state them.

Where an official page is silent, we say so and point you at it, rather than borrowing a number from somewhere less careful.

Questions

What is cap-gap?
The period that starts when an F-1 student's status and employment authorisation expires and, unless terminated, ends on 1 April of the fiscal year for which H-1B status is requested, or on the validity start date of the approved petition, whichever is earlier.
Did cap-gap change recently?
Yes. A DHS final rule effective 17 January 2025 extended cap-gap from 1 October to 1 April of the relevant fiscal year, applied beginning with the FY 2026 H-1B registration period. Older guidance describing 1 October is out of date.
What are the conditions for cap-gap?
The cap-subject H-1B petition must be properly and timely filed during the filing period beginning 1 April, while your authorised F-1 duration of status admission was still in effect, and it must request a change of status to H-1B within the fiscal year concerned.
Does cap-gap apply if my employer files for consular processing?
No. The petition must request a change of status to H-1B, not consular processing.
Do I keep working during cap-gap?
For the employment authorisation extension specifically, you must be in a valid period of post-completion OPT or STEM OPT. Cap-gap then extends that authorisation alongside your F-1 status.
What happens if my H-1B petition is denied?
The cap-gap extension terminates immediately and you have the standard 60-day grace period, measured from the date of notification of the denial, rejection, revocation or withdrawal, to depart the United States.
Is the 60 days counted from my OPT end date?
No. It runs from the date of notification of the denial, rejection, revocation or withdrawal of the petition.
Who should I ask about my own situation?
Your Designated School Official for anything tied to your SEVIS record, and an immigration attorney for the petition itself. This page is general information, not legal advice.
